Patents, copyrights, trademarks, and trade secrets are all considered intellectual property rights that allow an owner to benefit financially by limiting certain types of activities such as unauthorized use of another invention, the selling of unauthorized copies of another's work, selling a product as if it were that of another, or using proprietary business or product information owned by others. Lit.Econ LLP consultants have assisted trial lawyers and their clients in many types of intellectual property disputes. Our work has included the calculation of reasonable royalty rates, lost profits due to infringement, convoyed sales, incremental profit analysis, harm to reputation and goodwill, added costs and determination of gain by the infringer.

Golden Hour v. emsCharts (Federal District Court, Marshall, TX)Testified in federal court about the reasonable royalty owed to Golden Hour for infringement of its patent, and testified about price erosion based on the pricing structure for defendant’s infringing products.

TrekEight v. Symantec (Federal District Court, San Diego)Testified about the economic losses to a computer software business resulting from an alleged business interference by another party.

   

American Cal Car v. BMW  (Federal District Court, San Diego)  Prepared a report on the hypothetical royalty and economic losses to a company with several patents regarding the operation of a motor vehicle.

Redline Products v. Pro Chem  (Federal District Court, San Diego)  Prepared an economic loss report concerning lost earnings of a company that produces various cleaning products.  The company’s sales were interfered with by the actions of another market participant.

Bacus Labs v. Aperio  (Federal District Court, San Diego) Prepared a report on a hypothetical royalty rate for a company in the digital microscopic scanning industry.

 

Amini Innovations v. Roberts (Federal District Court, Los Angeles)  Estimated business losses in an intellectual property case involving the furniture industry.

Helix Technology v. Overland Data (Federal District Court, San Diego)  Estimated the economic losses associated with an alleged misuse of a corporate trademark.
